Brian’s litigation expertise involves advising clients on the resolution of charterparties, cargo claims, ship building, sale and purchase, commodity sales, marine insurance and bunker claims in all forms and stages of dispute resolution (High Court, arbitration and foreign litigation) as well as the enforcement of arbitration awards and judgements.

He also acts in a wide variety of transactional matters advising clients on the negotiation of shipbuilding contracts, contracts for the purchase of ships, charterparties and other commercial documentation.

Brian’s linguistic fluency in Spanish and good understanding of Portuguese have also involved him over the years in a wide range of private international law, insurance, reinsurance, commercial law and jurisdictional disputes involving clients in the Iberian Peninsula and Latin America. This expertise has also extended to clients in other areas of the world such as the Middle East. Reported cases in this varied area include:

  • Tryg Baltica v Boston Seguros and others [2005] Lloyd’s Rep IR 40 on the effect of pesification in Argentina upon underlying insurance and London reinsurance contracts.
  • Ministry of Trade of the Republic of Iraq v Tsavliris Salvage (International) Ltd (The”Altair”) [2008] 2 Lloyd’s Rep. on the authority of the master to conclude salvage contracts on behalf of cargo interests and issues of sovereign immunity
